United States v Carolene Products 1938

The District Court had earlier indicted Carolene Products Company on the United States v Carolene Products 1938 interstate commerce of filled milk referred to as Milnut. The court ruled it as a violation of the Filled Milk Act by Congress in 1923.

The case established the government’s constitutionality in restricting the movement of Japanese Americans during World War II as an issue of national security (Korematsu v United States, 214). The application of rational basis review in the Carolene Products case resulted in the level of judicial scrutiny.
