Search and Seizure: Exception to the Warrant Requirement

Search and seizure is a procedure employed in several civil and common law systems. Police and other legal authorities are permitted to conduct a search on personal property where they suspect a crime has been committed.

An authorized police or other officer should obtain a search and seizure warrant before invading into people’s premises according to Fourth Amendments of the bill of rights. However when search and seizure are accompanied by lawful arrest, there is a given consent from a close family member or any other person with a common access to the premises, and where the search is on automobile search can be conducted without a warrant.
