Bullying among American schools is a nationwide problem one that bears serious and in some cases, deadly consequences both to the victim, the perpetrator and the greater American society. Once considered as a comparatively harmless behavior, or simple rite of passage essential for building the character of young people, bullying is now associated with serious long-term negative effects for both the bully and their victims.

Such explicit anti-bullying laws will explicitly define bullying and the various forms that are referred to by the law and thus eliminate the constitutional legal hurdles raised by the First and fourteenth Amendments, which currently limit the authority of federal, state, local governments or schools from enacting and enforcing direct anti-bullying policies and legislations.
